1. Applicability of the terms and conditions
The deliveries, services, and offers of the webshop (hereinafter collectively referred to as "Appleladen.ch") of Andreas Amstutz Multimedia & Support (CHE-112.622.120 VAT), Kasimir-Pfyffer-Strasse 12, are exclusively subject to these terms and conditions, even if they are not expressly agreed upon again. By ordering goods or services, these terms and conditions are deemed accepted. The customer's general terms and conditions of purchase are hereby rejected. Deviations from these terms and conditions are only valid if confirmed in writing by Appleladen.ch .
2. Purchase price and payment terms
The agreed purchase price is subject to delivery from the logistics center or from Appleladen.ch , as contractually agreed in writing, and includes packaging and VAT. We reserve the right to change the VAT rate due to legal regulations, even if otherwise agreed. The purchase price is due upon transfer of risk and title to the goods and can be changed by Appleladen.ch at any time up to that point, particularly in the event of price increases or currency fluctuations. Payment is due net without any deductions and is payable in cash or, in the case of invoicing, within 7 days; default interest is 6.5% per annum.
If payment is not received within 14 days, we reserve the right to cancel the order. In this case, any reservation/pre-order will be forfeited.
3. Benefits and risks
Once the shipment has been handed over to the transport company, the statutory provisions of the Swiss Code of Obligations regarding the contract of carriage apply. This means, among other things, that after successful handover or deposit of the shipment by the transport company, the risk passes to the customer. If the customer does not wish for the shipment to be deposited, it is the customer's responsibility to inform the transport company (e.g., DPD, Post Office, etc.). To ensure and track correct delivery, the transport company may take photos (including geographical coordinates) of the deposited shipment. Any agreement by Appleladen.ch to cover transport costs in a specific case does not affect the transfer of risk.
4. Delivery dates
Appleladen.ch places great importance on providing up-to-date and accurate information regarding availability and delivery times in its online shop. However, due to production or supply bottlenecks, delivery delays may occur both at Digitec Galaxus itself and at retailers. Therefore, all information regarding availability and delivery times is provided without guarantee and is subject to change at any time.
5. Deliveries
Deliveries are made throughout Switzerland and in some European countries by arrangement with Appleladen.ch , which decides on the mode of transport at its own discretion. Shipping and delivery costs correspond to the rates valid at Appleladen.ch . We accept no liability for packages that are delivered to third parties and not directly to the intended recipient.
Refusal to accept ordered goods does not release the buyer from the obligation to pay the purchase price. All reminder and collection expenses in the event of default of acceptance or payment are borne by the buyer.
5.1 Deliveries Abroad
Swiss VAT is not charged on deliveries abroad.
The recipient pays the import customs clearance (including all fees) and any applicable import VAT and customs duties.
6. Complaints
Complaints must be made within 4 days of receipt of the shipment or acceptance of the goods – even in the case of partial deliveries or purchases. Complaints regarding inadequate packaging must be made the day after receipt of the goods. Packaging will not be taken back.
7. Goods returns
Returns are only accepted with prior written agreement from Appleladen.ch . The goods must be in perfect condition, in their original packaging (software unopened), and held in stock Appleladen.ch Appleladen.ch deduct a reasonable handling fee. We recommend sending returns by registered mail.
Return postage is always the responsibility of the sender.

8. Cancellations
Order cancellations require the written consent of Appleladen.ch Appleladen.ch to claim full reimbursement for any costs already incurred
If an item is returned without our consent, it will be returned at the buyer's expense or the delivery will be refused. Cancellation is not possible for installment payments made through the payment provider HeidiPay/Klarna.
9. Warranty
Appleladen.ch or the supplier/manufacturer guarantees the ordered product to be free from defects and fully functional for two years after delivery, unless otherwise expressly agreed in writing.
Exceptions are listed in section 10.1.
Appleladen.ch will, at their discretion, repair or replace the goods free of charge. Any travel or transport costs are the responsibility of the buyer. Warranty replacement or repair does not extend the original warranty period.
The statutory warranty is completely excluded.
10. Liability
Unless otherwise agreed in writing, Appleladen.ch is not liable for damages arising from the non-performance or improper performance of the purchase agreement or for the operation or use of the purchased item. In any case, Appleladen.ch assumes no liability whatsoever for lost profits, indirect or consequential damages, including, in particular, data loss of any kind, which may be incurred by the buyer or a third party. Appleladen.ch is entitled, at its own discretion, to be represented in whole or in part by its suppliers in legal and extrajudicial proceedings. The buyer's consent in such cases is deemed to have been given without any further action on their part.
10.1 Additional provisions Warranty and liability
Warranty claims for normal wear and tear, as well as consumables/accessories/included batteries/rechargeable batteries, are excluded (this list is not exhaustive).
For used/pre-owned/refurbished products, the stated warranty period applies.
Apple replacement parts, whether originally supplied by Apple or imported by us, are covered by a 6-month parts warranty, and batteries are covered by a 1-year warranty. These items are excluded from the warranty. The statutory warranty is fully excluded.
Warranty claims against Appleladen.ch are only valid for the original purchaser and are not transferable.
We accept no liability for repairs carried out by the customer.
11. Maintenance
The repair and maintenance of hardware, including peripherals, is guaranteed by Appleladen.ch or its suppliers under a separate repair order or maintenance contract for a fee. Software repair and maintenance are excluded from this guarantee in all cases. Likewise, Appleladen.ch is not obligated to further develop or have further developed any software, nor to release, offer, or announce any changes or additions.
12. Retention of title
The delivered goods remain the property of Appleladen.chuntil full payment has been received. Appleladen.ch is entitled to register a corresponding reservation of title in the public register.
13. Right of return
There is generally no right of return. The law of obligations applies.
14. General Provisions
All amendments and additions to these Terms and Conditions must be in writing. Appleladen.ch reserves the right to amend or supplement these Terms and Conditions at any time. The place of jurisdiction and performance is Lucerne, Switzerland. Swiss law applies.
